خون کی حرمت
حضرت عبداللہ بن عمر رضی اللہ تعالیٰ عنہ سے روایت ہے کہ وہ رسول اللہ صلی اللہ علیہ وسلم سے بیان کرتے ہیں کہ آپ نے فرمایا: "جو مسلمان اس بات کی گواہی دیتا ہو کہ اللہ کے علاوہ کوئی معبود نہیں اور محمد صلی اللہ علیہ وسلم اللہ کے رسول ہیں، تو اس کا خون بہانا جائز نہیں، تین صورتوں کے علاوہ: جان کے بدلے جان، شادی شدہ زانی، اور دین اسلام کو چھوڑنے والا یعنی مسلمانوں کی جماعت سے الگ ہونے والا۔" (بخاری)
اس حدیث میں تین باتیں بیان کی گئی ہیں۔ پہلی یہ کہ اس بات کی گواہی کہ اللہ تعالیٰ کے سوا کوئی معبود نہیں اور محمد اللہ کے رسول ہیں، انسان کو (جو پہلے مسلمان نہیں تھا) دائرہ اسلام میں داخل کر دیتی ہے، جس کے نتیجے میں اس کا خون بہانا اسی طرح ناجائز ہو جاتا ہے جس طرح کسی دوسرے پیدائشی مسلمان کا۔
حدیث کا حاصل یہ ہے کہ کسی مسلمان کا خون بہانا جائز نہیں مگر یہ کہ وہ خود کوئی ایسا حق کر دے کہ وہ خون کے بدلے خون کے اصول کے تحت اس کو قتل کیا جا سکتا ہے۔ اسی طرح اگر کوئی شادی شدہ شخص، مسلمان اور آزاد، زنا کا مرتکب ہو تو اس کو سنگسار کر دیا جائے، اور جو مسلمان دین سے نکل جائے یعنی مرتد ہو جائے اس کو قتل کر دینا بھی جائز ہے۔
اللہ تعالیٰ نے یہ دنیا اور جو کچھ اس میں ہے مسلمان کے لیے پیدا کیا ہے تا کہ وہ پروردگار کی عبادت کرے، لہٰذا جس شخص نے کسی مسلمان کو قتل کیا اس نے پوری دنیا کو فنا کے گھاٹ اتار دیا۔ چنانچہ اللہ ربّ العزت کا فرمان ہے: (ترجمہ) "جو شخص کسی کو (نا حق) قتل کرے گا (یعنی) بغیر اس کے کہ جان کا بدلہ لیا جائے یا ملک میں خرابی کرنے کی سزا دی جائے، اس نے گویا تمام لوگوں کو قتل کیا۔" (المائدہ ۳۲)
اصطلاحِ شریعت میں قاتل کی جان لینا، یعنی جس شخص نے کسی کو نا حق قتل کیا ہو اس کو مقتول کے بدلے میں قتل کر دینا، اس کو قصاص کہتے ہیں، اور اللہ رب العزت نے قصاص میں زندگی قرار دیا ہے، فرمانِ رب ہے: (ترجمہ) "اور تمہارے لیے قصاص میں زندگی ہے، اے عقل مندو، تا کہ تم (قتل کرنے سے) پرہیز کرنے لگو۔" (البقرہ ۱۷۹)
لیکن خود کو عقل مند کہنے والے اس سزا کو ظالمانہ اور وحشیانہ کہتے ہیں۔ ان کے نزدیک قاتل کو قتل نہ کرنا انسانیت پر رحم ہے، لیکن اسی منطق کا نتیجہ وہ بھگت رہے ہیں کہ آج انسانی زندگی کی کوئی قیمت نہیں بچی، قتل و غارت گری عام ہے، جرم پھل پھول رہا ہے، مجرموں کا ہاتھ پکڑنے والا کوئی نہیں! لیکن مظلوم اور بے بس انسان انصاف کے لیے تڑپ رہے ہیں!
حدیث کا حاصل یہ ہے کہ کسی مسلمان کا خون بہانا جائز نہیں مگر یہ کہ وہ خود کوئی ایسا حق کر دے کہ وہ خون کے بدلے خون کے اصول کے تحت اس کو قتل کیا جا سکتا ہے۔ اسی طرح اگر کوئی شادی شدہ شخص، مسلمان اور آزاد، زنا کا مرتکب ہو تو اس کو سنگسار کر دیا جائے، اور جو مسلمان دین سے نکل جائے یعنی مرتد ہو جائے اس کو قتل کر دینا بھی جائز ہے۔

English translation
'Abdullah bin 'Umar (may Allah be pleased with him) narrated from the Messenger of Allah ﷺ that he said: "For a Muslim who bears witness that there is no god but Allah and that Muhammad ﷺ is the Messenger of Allah, it is not lawful to shed his blood except in three cases: a life for a life; the married person who commits adultery; and one who abandons the religion of Islam, that is, one who separates from the community of the Muslims."
Three things are stated in this hadith. The first is that bearing witness that there is no god but Allah the Exalted and that Muhammad is the Messenger of Allah brings a person (who was not previously a Muslim) into the fold of Islam, as a result of which shedding his blood becomes as unlawful as that of any other born Muslim.
The gist of the hadith is that shedding the blood of any Muslim is not lawful, unless he himself commits some act by which, under the principle of a life for a life, he may be killed. Likewise, if a married, free Muslim commits adultery, he is to be stoned; and a Muslim who leaves the religion, that is, apostatises, may also be killed.
Allah the Exalted created this world and all that is in it for the Muslim, so that he may worship his Lord; therefore whoever kills a Muslim, it is as though he has destroyed the whole world. Thus Allah, Lord of Honour, says: (translation) "Whoever kills a person — unless it be for a life, or for spreading corruption in the land — it is as though he had killed all of mankind." (Al-Ma'idah 32)
In the terminology of the Shari'ah, taking the life of the killer — that is, killing in return the one who unjustly killed someone, in recompense for the slain — is called qisas (retribution), and Allah, Lord of Honour, has placed life in qisas. The Lord says: (translation) "And there is life for you in retribution, O people of understanding, so that you may guard yourselves (against killing)." (Al-Baqarah 179)
But those who call themselves people of understanding call this punishment cruel and savage. In their view, not killing the murderer is mercy upon humanity — yet they are suffering the result of this very logic: today human life has no value left, killing and plunder are rife, crime flourishes, and there is no one to seize the hand of the criminals! But the oppressed and helpless people are writhing for justice!
