بکے ہوئے مال کا واپس لے لینا

حضرت ابو ہریرہ رضی اللہ تعالیٰ عنہ سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے ارشاد فرمایا کہ: “جس نے اپنا بکا ہوا مال اپنے (خریدار) مسلمان بھائی (کی خواہش) سے واپس لوٹا لیا اللہ تعالیٰ قیامت کے دن اس کی غلطیاں (یعنی اس کے گناہ) بخش دے گا۔” (ابو داؤد و ابن ماجہ)
دین اسلام صرف عبادات کا مذہب نہیں بلکہ یہ زندگی کے ہر شعبے کے متعلق انسان کو تعلیمات دیتا ہے۔ شریعت اسلامیہ نے جہاں عبادات، معاملات و معاشرت کے بارے میں احکامات اور ان پر عمل کرنے پر اجر و ثواب اور نہ کرنے پر عذاب کی وعیدیں فرمائی ہیں وہیں خرید و فروخت کے معاملات اور لین دین کے متعلق بھی احکامات بتائے ہیں جن میں کچھ صورتوں سے منع فرمایا ہے، اسی طرح کچھ چیزیں اور اشیاء ایسی ہیں جن کی خرید و فروخت شرعی نقطہ نظر سے ممنوع ہیں، اور کچھ صورتیں ایسی ہیں جو کہ حلال ہونے کے باوجود ان میں رعایتیں دینے پر انتہائی اجر و ثواب کا وعدہ ہے۔

خرید و فروخت کی بعض صورتیں تو ایسی ہوتی ہیں کہ خریدار مال کو واپس کرنے کا قانونی طور پر حقدار ہوتا ہے، مگر جب ایسی کوئی شرط اور معاہدہ یا بات نہ ہو اور دو آدمیوں کے درمیان کسی چیز کی خرید و فروخت کا معاملہ طے ہوا اور فریقین کی طرف سے بات بالکل ختم ہوگئی، لین دین بھی ہوگیا، اس کے بعد کسی ایک نے اپنی مصلحت سے معاملہ ختم کرنا چاہا، مثلاً خریدار نے جو چیز خریدی تھی اس کو واپس کرنا چاہا یا بیچنے والے نے اپنی چیز واپس لینی چاہی تو اگرچہ قانون شریعت کی رو سے دوسرا فریق مجبور نہیں ہے کہ وہ اس کے لیے راضی ہو، یعنی بعض اوقات ایک شخص کسی سے کوئی چیز خرید لیتا ہے، لیکن بعد میں کسی وجہ سے وہ واپس کرنا چاہتا ہے، ایسی صورت میں بیچنے والے کے ذمے یہ واجب تو نہیں ہے کہ وہ ضرور بیچی ہوئی چیز واپس لینا منظور کرے لیکن اگر وہ خریدار کی پشیمانی یا اس کی ضرورت کو دیکھتے ہوئے واپسی منظور کرلے تو اس حدیث مبارکہ میں رسول اللہ صلی اللہ علیہ وسلم نے اخلاقی انداز میں اس کی فضیلت بیان کرتے ہوئے اس عمل کو کرنے والے کے لیے بڑی نیکی اور روز قیامت کے دن بڑے اجر کا اعلان فرمایا ہے۔

اسلام کا تصور اخلاق صرف اتنا نہیں کہ ایک انسان کسی دوسرے کے ساتھ نرمی اور محبت سے پیش آئے۔ اسلام کا تصور اخلاق اس سے کہیں بلند اور آگے ہے، خالص دنیاوی معاملات میں بھی اس کی تعلیمات میں اخلاق کا پہلو نمایاں نظر آئے گا۔ یہ حدیث اس کا منہ بولتا ثبوت ہے۔

کسی چیز کو خرید کر یا بیچ کر انسان واپس کرنا یا واپس لینا اسی وقت چاہتا ہے جب وہ محسوس کرتا ہے کہ مجھ سے غلطی ہوگئی اور میں اس معاملہ میں نقصان اور خسارہ میں رہا اور دوسرا فریق نفع میں رہا، اس صورت میں دوسرے فریق کا معاملہ خرید و فروخت ختم کرکے واپسی پر راضی ہوجانا بلاشبہ ایثار ہوگا، رسول اللہ صلی اللہ علیہ وسلم نے اس ارشاد میں اس ایثار ہی کی ترغیب دی ہے اور ایسا کرنے والے کو بشارت سنائی ہے کہ اللہ تعالیٰ اس کے بدلے قیامت میں اس کے قصوروں، کوتاہیوں اور گناہوں سے درگزر فرمائے گا، بلاشبہ یہ اگر انسان سمجھے تو بڑا ہی نفع بخش سودا ہے۔

یہ تو واپس لینے والے کے حوالے سے بات ہوئی لیکن واپس کرنے والے پر بھی کچھ اخلاقی ذمہ داریاں عائد ہوتی ہیں۔ آج کل بہت سے تجارتی ادارے، بڑے بڑے خریداری کے مراکز میں خریداروں کو یہ سہولت دی جاتی ہے کہ وہ کسی مقررہ مدت میں خریدی ہوئی چیز کو تبدیل کرالیں یا واپس کردیں، بعض افراد ان سہولتوں کا ناجائز فائدہ بھی اٹھا رہے ہیں، بیچنے والا یہاں جہاں یہ سہولت دے کر اتنے بڑے اجر و ثواب کا امیدوار ہو رہا ہے وہیں کچھ لوگ اس سہولت کے پیش نظر اس طرح سے فائدہ اٹھاتے ہیں کہ اپنی وقتی ضرورت کو پورا کرکے اسے واپس کردیتے ہیں جو کہ سراسر دھوکہ دہی کے زمرے میں آتا ہے، اور حقیقتاً وہ نقصان کا سودا ہے، اللہ تعالیٰ تمام مسلمانوں کو اس قسم کی برائیوں سے بچنے کی اور کاروباری حضرات کو اس حدیث مبارکہ پر عمل کرنے کی توفیق عطا فرمائے، جو کہ آخرت کے لیے انتہائی نفع بخش سودا ہے۔
English translation
Narrated from Abu Hurayrah (may Allah be pleased with him): The Messenger of Allah صلى الله عليه وسلم said: “Whoever takes back the goods he had sold, at the wish of his (buyer) Muslim brother, Allah will forgive his errors (that is, his sins) on the Day of Resurrection.”

The religion of Islam is not merely a religion of acts of worship; rather it gives man guidance concerning every sphere of life. Just as Islamic Shariah has laid down rulings about worship, dealings and social conduct — with warnings of reward for acting upon them and of punishment for not — so too it has given rulings concerning trade and transactions, forbidding certain forms of them. In the same way there are certain things and goods whose buying and selling is forbidden from the Shariah point of view; and there are certain cases in which, despite a thing being lawful, a promise of immense reward is attached to showing concessions in them.

Some cases of buying and selling are such that the buyer is legally entitled to return the goods; but when there is no such condition, agreement or stipulation, and a transaction over some item has been settled between two persons and the matter has been entirely concluded on both sides and the exchange has taken place — after that, if one of the two, out of his own interest, wishes to cancel the deal (for example, the buyer wishes to return the thing he bought, or the seller wishes to take back his goods) — then, although under the law of the Shariah the other party is not obliged to agree to it (that is, sometimes a person buys something from another but later, for some reason, wishes to return it, and in such a case it is not obligatory upon the seller to agree to take back the sold item) — yet if he, seeing the buyer’s regret or need, agrees to take it back, then in this blessed hadith the Messenger of Allah ﷺ, describing its virtue in a moral light, has announced great goodness and a great reward on the Day of Resurrection for the one who does this.

Islam’s conception of morality is not merely that one person should deal with another gently and lovingly. Islam’s conception of morality is far higher and more advanced than that; even in purely worldly dealings, the aspect of morality is prominently visible in its teachings. This hadith is a living proof of that.

Having bought or sold something, a person wishes to return it or take it back only when he feels that he has made a mistake and remained at a loss and disadvantage in the deal while the other party gained. In such a case, for the other party to cancel the transaction and agree to the return is, without doubt, an act of self-sacrifice (ithar). In this saying the Messenger of Allah ﷺ has encouraged this very self-sacrifice, and given glad tidings to the one who does it, that Allah will, in return, on the Day of Resurrection, overlook his faults, shortcomings and sins. Without doubt, if a person understands it, this is a most profitable bargain.

That was regarding the one who takes goods back; but some moral responsibilities also fall upon the one who returns goods. These days many commercial establishments and large shopping centres give customers the facility of exchanging or returning a purchased item within a fixed period. Some people are even taking unfair advantage of these facilities. Whereas the seller, by granting this facility, hopes for such great reward, some people, in view of this facility, take advantage in such a way that they fulfil their temporary need and then return the item — which amounts to sheer deception, and is in reality a losing bargain. May Allah grant all Muslims the ability to avoid such evils, and grant businesspeople the ability to act upon this blessed hadith — which is a most profitable bargain for the Hereafter.
