امیر یا حاکم کی اطاعت کب تک؟
حضرت ابن عمر رضی اللہ تعالیٰ عنہ سے روایت ہے کہ نبی کریم صلی اللہ علیہ وسلم نے ارشاد فرمایا: ”مسلمان مرد پر (اپنے مسلمان حکمران کی بات) سننا اور ماننا فرض ہے، وہ بات اسے پسند ہو یا ناپسند، سوائے اس کے کہ اسے گناہ کرنے کا حکم دیا جائے، پس جب اسے اللہ کی نافرمانی کا حکم دیا جائے تو پھر اس پر سننا اور ماننا فرض نہیں (بلکہ انکار کرنا ضروری ہے)۔“ (بخاری و مسلم)
امیر و حاکم کی بات کو سننا اور اس کے احکام و فرامین کی اطاعت کرنا ہر مسلمان پر واجب ہے، خواہ اس کا حکم و فرمان طبعیت و پسند کے موافق ہو یا غیر موافق، لیکن شرط یہ ہے کہ اس کا کوئی حکم شریعت کی حدود سے باہر نہ ہو، ایسی صورت میں تو اس کی اطاعت وفرمانبرداری واجب نہیں ہوگی، یہاں مسلمانوں کے لیے مسلم حکمرانوں کی اطاعت کی حدود واضح کردی گئی ہیں، مسلم حکمرانوں کی عزت اسی میں ہے کہ وہ اللہ اور اس کے رسول صلی اللہ علیہ وسلم کے حکموں سے انحراف نہ کریں ورنہ آخرت کے عذاب کے علاوہ دنیاوی ذلت سے بھی محفوظ نہیں رہیں گے، تاریخی طور پر اور آج کل کے حالات سے اس بات کا مشاہدہ ہر ذی شعور انسان بخوبی کرسکتا ہے، کہیں کل کے امیر آج کے اسیر ہیں اور کہیں اپنی ہی سرزمین ان کے لیے تنگ کردی گئی ہے۔
شریعت اسلام کے مطابق حکمراں لوگوں پر اقتدارِ اعلیٰ نہیں رکھتا، بس وہ ایک نمائندہ کارکن ہے جسے لوگوں نے منتخب کیا ہے اور اس کے اختیارات کا سرچشمہ اللہ تعالیٰ کے قانون کی اطاعت ہے، وہ قانون جو حکمراں اور رعایا دونوں پر یکساں عائد ہوتا ہے اور ایک سنجیدہ باوقار عہد (جسے آج کل الیکشن کہتے ہیں) سے اس کی تکمیل ہوتی ہے، جس پر اللہ تعالیٰ خود شاہد ہے، وہ حکمراں جو لوگوں کے ذریعے منتخب ہوکر اللہ تعالیٰ کے احکام کے مطابق حکومت کرنے آتے ہیں لوگوں کی اطاعت اور حمایت کے مستحق اسی وقت تک ہیں جب تک وہ خود اللہ تعالیٰ کے احکام کے پابند رہیں۔ اگر عوام ایسے حکمرانوں کو اپنی حمایت اور تعاون پیش نہ کرے تو ان کا یہ فعل انتظامیہ کے خلاف غیر ذمہ دارانہ قانونی خلاف ورزی شمار ہوگی اور اللہ تعالیٰ کی نافرمانی بھی۔ اسی طرح اگر حکمراں اللہ تعالیٰ کے متعین کردہ راستہ سے ہٹ جاتے ہیں یا اس کے قانون کی پابندی نہیں کرتے تو یہ بھی نہ صرف عوام کے ساتھ ہی خلاف ورزی اور بدعہدی ہے بلکہ وہ عوام کی حمایت اور وفاداری کا حق کھو دیتے ہیں۔
اسی بات کو قرآن کریم میں اس پیرائے میں بیان کیا گیا ہے۔
اے لوگو! جو ایمان لائے ہو اطاعت کرو اللہ کی اور اطاعت کرو رسول صلی اللہ علیہ وسلم کی اور ان لوگوں کی جو تم میں سے صاحب امر ہوں، پھر اگر تمہارے درمیان کسی معاملہ میں نزاع ہو جائے تو اسے اللہ اور رسول صلی اللہ علیہ وسلم کی طرف پھیر دو اگر تم اللہ اور روز آخرت پر ایمان رکھتے ہو، یہی ایک صحیح طریق کار ہے اور انجام کے اعتبار سے بھی بہتر ہے۔ (النساء ۵۹)
یہاں بات وضاحت کے ساتھ بیان کی گئی ہے کہ امراء و حکام کی اطاعت اگر چہ ضروری ہے لیکن وہ اللہ اور رسول صلی اللہ علیہ وسلم کی اطاعت کے ساتھ پابند ہے، کیونکہ گناہ میں اطاعت نہیں، اطاعت صرف معروف اور نیکی میں ہے، جیسا کہ ایک روایت میں اس طرح آتا ہے۔ کسی بھی ایسے حکم کی اطاعت و فرمانبرداری جائز نہیں ہے جس کا تعلق گناہ سے ہو (خواہ وہ حکم امیر و حاکم کی طرف سے ہو یا ماں باپ اور استاد کی طرف سے) اطاعت وفرمانبرداری تو صرف اچھے حکم میں واجب ہے۔ (بحوالہ بخاری و مسلم)
لہٰذا اولی الامر یعنی حکمراں یا منتخب نمائندوں کی اطاعت اسی وقت تک ہوگی جب وہ خود اللہ اور اس کے رسول صلی اللہ علیہ وسلم کی اطاعت کریں، اللہ کے رسول صلی اللہ علیہ وسلم نے اپنے ایک فیصلہ کن بیان میں فرمایا تھا کہ کسی ایسے انسان کی وفاداری اور اطاعت کسی پر فرض نہیں جو خود اللہ تعالیٰ کی اطاعت نہیں کرتا اور خود کو اس کے قانون کا پابند نہیں بناتا، رسول اللہ صلی اللہ علیہ وسلم کے ابتدائی جانشین اس اصول کو بہت واضح طور پر سمجھتے تھے اور انہوں نے اپنی پالیسی کے بارے میں پہلے ہی بیان میں صاف طور پر اعلان کردیا تھا کہ ان کی اطاعت اور حمایت لوگوں پر اس وقت تک فرض ہے جب تک کہ وہ خود اللہ تعالیٰ کی اطاعت میں سرگرم رہیں اور اگر وہ اللہ تعالیٰ کی بتائی ہوئی راہ سے ہٹ جائیں تو انہیں اللہ تعالیٰ کے بندوں سے اطاعت کرنے کا کوئی حق نہ رہے گا۔
لہٰذا قرآن پاک کی واضح آیتوں اور ان احادیث کی روشنی میں اب ان حکمرانوں کا فرض ہے جن کو لوگوں نے منتخب کیا ہے وہ اس منصب کو ایک اہم اور ذمہ داری کا منصب جانتے ہوئے انتہائی عدل و انصاف کے ساتھ اپنے ملک کے لوگوں کی بلا تفریق خیر خواہی و فلاح کے اقدامات کریں، اور اپنا منشور قرآن و سنت کو بنائیں۔

لہٰذا قرآن پاک کی واضح آیتوں اور ان احادیث کی روشنی میں اب ان حکمرانوں کا فرض ہے جن کو لوگوں نے منتخب کیا ہے وہ اس منصب کو ایک اہم اور ذمہ داری کا منصب جانتے ہوئے انتہائی عدل و انصاف کے ساتھ اپنے ملک کے لوگوں کی بلا تفریق خیر خواہی و فلاح کے اقدامات کریں، اور اپنا منشور قرآن و سنت کو بنائیں۔
English translation
Ibn Umar (may Allah be pleased with him) reported that the Prophet (peace and blessings be upon him) said: "It is obligatory upon the Muslim man to listen to and obey (the word of his Muslim ruler), whether he likes it or dislikes it, unless he is commanded to commit a sin. So when he is commanded to disobey Allah, then listening and obeying is not obligatory upon him (rather refusal is necessary)."
Listening to the word of the leader and ruler and obeying his commands and orders is obligatory upon every Muslim, whether his command and order accords with one's temperament and liking or not — but on the condition that none of his commands falls outside the limits of the Shariah; in such a case obedience to him will not be obligatory. Here the limits of obedience to Muslim rulers have been made clear for the Muslims. The honour of Muslim rulers lies in this: that they do not deviate from the commands of Allah and His Messenger (peace and blessings be upon him); otherwise, besides the punishment of the Hereafter, they will not be safe even from worldly humiliation. Every person of understanding can observe this well, both from history and from present-day circumstances: in some places the leader of yesterday is the captive of today, and in some places their own land has been made narrow for them.
According to the Shariah of Islam, the ruler does not hold supreme authority over the people; he is merely a representative worker whom the people have elected, and the source of his powers is obedience to the law of Allah — the law that falls equally upon ruler and subjects alike, and whose fulfilment comes about through a serious, dignified covenant (what is nowadays called an election), to which Allah Himself is witness. Those rulers who, elected by the people, come to govern in accordance with the commands of Allah, deserve the obedience and support of the people only so long as they themselves remain bound by the commands of Allah. If the public do not offer such rulers their support and cooperation, this act of theirs will be counted as an irresponsible legal violation against the administration, and also disobedience to Allah. Likewise, if the rulers turn away from the path appointed by Allah or do not abide by His law, this too is not only a violation and breach of covenant against the people, but they also lose the right to the people's support and loyalty.
This same point has been stated in the Holy Qur'an in this manner: "O you who believe! Obey Allah, and obey the Messenger (peace and blessings be upon him) and those among you who are in authority. Then if you dispute in any matter, refer it to Allah and the Messenger (peace and blessings be upon him), if you believe in Allah and the Last Day. This is the correct course, and better in the end." (An-Nisa 59)
Here the matter has been stated with clarity: that although obedience to leaders and rulers is necessary, it is bound together with obedience to Allah and the Messenger (peace and blessings be upon him), because there is no obedience in sin — obedience is only in what is good and righteous, as it comes in a narration: obedience and compliance to any command connected with sin is not permissible (whether that command be from a leader and ruler or from parents and teacher); obedience and compliance is obligatory only in a good command. (Reported by Bukhari and Muslim)
Therefore, obedience to those in authority — that is, rulers or elected representatives — will hold only so long as they themselves obey Allah and His Messenger (peace and blessings be upon him). The Messenger of Allah (peace and blessings be upon him) said in a decisive statement that the loyalty and obedience of any person who himself does not obey Allah and does not bind himself to His law is not obligatory upon anyone. The earliest successors of the Messenger of Allah (peace and blessings be upon him) understood this principle very clearly and, in their very first address concerning their policy, plainly declared that their obedience and support was obligatory upon the people only so long as they themselves remained active in obedience to Allah, and that if they turned away from the path shown by Allah, they would have no right to obedience from the servants of Allah.
Therefore, in the light of the clear verses of the Holy Qur'an and these hadiths, it is now the duty of those rulers whom the people have elected to regard this office as an important office of responsibility, and, with the utmost justice and equity, to take measures for the welfare and prosperity of the people of their country without discrimination, and to make their manifesto the Qur'an and Sunnah.
