قتل
حضرت عبداللہ ابن مسعود رضی اللہ تعالیٰ عنہ سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے ارشاد فرمایا: ”قیامت کے دن سب سے پہلے جس چیز کے بارے میں فیصلہ کیا جائے گا وہ خون ہے۔“ ((بخاری و مسلم))
انسان بحیثیت انسان انتہائی محترم مخلوق ہے، اس لیے اللہ تعالیٰ نے اسے خود اپنے ہاتھوں سے بنایا ہے، انتہائی خوبصورت جسم، ساخت اور شکل عطا فرمائی، فرشتوں سے سجدہ کروایا اور دنیا جہاں کی نعمتیں اس کی خدمت اور فائدے کے لیے پیدا کیں، لہٰذا ہر انسان کی عزت، مال اور جان لائقِ احترام اور قابلِ حفاظت ہے، سوائے اس کے کہ یہ انسان خود اپنے اس مقام و احترام کو ضائع کر دے، چنانچہ درج ذیل صورتوں کے علاوہ کسی صورت میں انسان کا خون (خواہ وہ کافر ہی کیوں نہ ہو) بہانا ہرگز جائز اور صحیح نہیں۔
(۱) اسلام قبول کرنے کے بعد مرتد ہو جائے۔ (۲) شادی شدہ ہوتے ہوئے کے بعد زنا کا ارتکاب کرے۔ (۳) کسی دوسرے انسان کو جان بوجھ کر قتل کرے اور معروف قانونی طریقے سے اس کا جرم ثابت ہو جائے۔ (۴) اللہ کی زمین پر فساد برپا کرے، مثلاً ڈاکے ڈالے، لوٹ مار اور رہزنی کرے یا اسلامی حکومت کے خلاف بغاوت کرے۔ (۵) دینِ حق قائم کرنے کی بزور بازو مخالفت کرے اور اسے قتل کیے بغیر بات نہ بنتی ہو۔
خون کا معاملہ چونکہ نہایت سنگین ہے اس لیے فیصلے کے لیے سب سے پہلے خون کے مقدمات ہی پیش ہوں گے، ایک حدیث سے معلوم ہوتا ہے کہ سب سے پہلے قیامت کے روز نماز کے بارے میں پوچھا جائے گا، درحقیقت ان دونوں حدیثوں میں کوئی تضاد نہیں پایا جاتا ہے، اصل حقیقت یہ ہے کہ حقوق اللہ کی ادائیگی کے سلسلہ میں سب سے پہلے جس چیز کے بارے میں سوال ہو گا وہ نماز ہے، اس لیے کہ حقوق اللہ میں سب سے بنیادی اور اہم نماز ہی ہے۔ حقوق العباد یعنی بندگانِ خدا کے جو حقوق ہم پر عائد ہوتے ہیں ان میں سب سے اہم یہ ہے کہ ہم ان کے خیر خواہ ہوں، اب اگر کوئی کسی شخص کو بلا شرعی سبب کے قتل کرتا ہے تو اس کے بارے میں اس کے سوا اور کیا کہا جائے کہ وہ اتنا بڑا ظالم ہے کہ بندگانِ خدا کے دوسرے حقوق تو کیا ادا کرتا، اسے تو دوسرے کا وجود ہی گوارا نہ ہوا۔ انسان کے سارے حقوق اس کے وجود و بقا سے تعلق رکھتے ہیں، قتلِ ناحق سے آدمی کے سارے حقوق کی نفی ہو جاتی ہے، علاوہ اس کے انسان کے سارے معاملات اور اس کے اعمال کا تعلق اس کی زندگی سے ہوتا ہے، زندگی کا خاتمہ کر دینے سے اعمال کے سارے سلسلے منقطع ہو جاتے ہیں، قتل کا مطلب یہ ہوتا ہے کہ آدمی کی ساری دوڑ دھوپ اور اس کی سرگرمیوں کا خاتمہ کر دیا جائے، اس لیے قتلِ ناحق ایک سنگین جرم ثابت ہوتا ہے کہ حقوق العباد کے سلسلہ میں سب سے پہلے اس کے بارے میں باز پرس ہونی چاہیے۔
انسانی قتل شرک کے بعد سب سے بڑا جرم ہے۔ ارشادِ باری تعالیٰ ہے۔ ﴿اور جس کا خون کرنا اللہ تعالیٰ نے حرام کر دیا ہے اس کو قتل مت کرو، ہاں مگر حق کے ساتھ﴾ (الانعام ۱۵۱۔ بنی اسرائیل ۳۳) یعنی حق کے ساتھ قتل کرنے سے مراد قصاص میں قتل کرنا ہے، یعنی مقتول کے وارثوں کو یہ حق یا غلبہ یا طاقت دی گئی ہے کہ وہ قاتل کو قصاص میں قتل کریں یا اس سے دیت لے لیں یا معاف کر دیں، قصاص کو انسانی معاشرے کی زندگی اور امن و سکون کا باعث قرار دیا گیا ہے۔ جیسا کہ ارشادِ باری تعالیٰ ہے۔ ﴿قصاص میں تمہارے لیے زندگی ہے، اس باعث تم (قتلِ ناحق سے) رکو گے﴾ (البقرۃ ۱۷۹) جب قاتل کو یہ خوف ہو گا کہ میں بھی قصاص میں قتل کر دیا جاؤں گا تو پھر اسے کسی کو قتل کرنے کی جرات نہیں ہو گی اور جس معاشرے میں یہ قانون نافذ ہو جاتا ہے وہاں یہ خوف معاشرے کو قتل و خونریزی سے محفوظ رکھتا ہے، جس سے معاشرے میں نہایت امن اور سکون رہتا ہے۔ ایک اور روایت میں اس طرح آتا ہے۔ مومن اپنے دین کی وسعت اور کشادگی میں اس وقت تک برابر رہتا ہے جب تک کہ وہ کسی حرام خون کو نہیں بہاتا۔ (بحوالہ بخاری)
یوں تو ہر برائی انسان کی دینی اور اخلاقی زندگی کے لیے زوال کا باعث اور غضبِ خداوندی کا موجب ہے، لیکن یہاں بطورِ خاص خونِ ناحق کے بدترین فعل کے بارے میں واضح کیا گیا ہے کہ جب تک کوئی شخص کسی کے خونِ ناحق سے اپنا ہاتھ نہیں رنگتا اس پر رحمتِ خداوندی کا ہاتھ رہتا ہے، لیکن جب کوئی شخص خونِ ناحق سے اپنا ہاتھ رنگ لیتا ہے تو اس پر تنگی مسلط ہو جاتی ہے اور وہ ان لوگوں میں شامل ہو جاتا ہے جو رحمتِ خداوندی سے محروم رہتے ہیں۔

English translation
It is narrated from Abdullah ibn Mas’ud (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said: “On the Day of Resurrection, the first matter concerning which judgement will be passed (among people) is bloodshed.” (Bukhari and Muslim)
Man, as a human being, is an exceedingly honoured creation; this is why Allah created him with His own hands, granted him an exceedingly beautiful body, structure and form, made the angels prostrate (to Adam), and created the bounties of the whole world for his service and benefit. Therefore, every human being’s honour, wealth and life are worthy of respect and deserving of protection, except that the human being himself squanders this station and honour of his. Accordingly, apart from the following cases, it is never permissible or right to shed a person’s blood (even if he be a disbeliever):
(1) That, after accepting Islam, he becomes an apostate. (2) That, being married, he commits adultery. (3) That he deliberately murders another human being and his crime is proven by the recognised legal procedure. (4) That he spreads corruption on Allah’s earth — for example, commits armed robbery, plunder and highway robbery, or rebels against an Islamic government. (5) That he forcibly opposes the establishment of the true religion and the matter cannot be settled without killing him.
Since the matter of bloodshed is extremely grave, the cases of bloodshed will be the first to be brought forward for judgement. From another hadith it is known that on the Day of Resurrection the first thing asked about will be the prayer; in reality there is no contradiction between these two hadiths. The true fact is that in the matter of fulfilling the rights of Allah (huquq Allah), the first thing about which one will be questioned is the prayer, because among the rights of Allah the most fundamental and important is the prayer itself. As for the rights of servants (huquq al-ibad) — that is, the rights of the servants of Allah that fall upon us — the most important is that we be their well-wishers. Now if someone kills a person without a lawful (Shar’i) cause, what can be said about him except that he is so great a wrongdoer that, far from fulfilling the other rights of the servants of Allah, he could not even tolerate the other’s very existence. All of a person’s rights are connected to his existence and survival; by unlawful killing all the rights of a person are nullified. Besides this, all of a person’s dealings and his deeds are connected to his life; by ending his life all the chains of deeds are cut off. To kill means that all of a person’s striving and his activities are brought to an end. For this reason, unlawful killing proves to be so grave a crime that, in the matter of the rights of servants, it should be the first thing about which he is called to account.
Human murder is the greatest crime after polytheism. Allah the Exalted says: “And do not kill the one whose killing Allah has forbidden, except with right (i.e. by due right).” (Al-An’am 6:151; Bani Isra’il 17:33) That is, killing “with right” means killing in retaliation (qisas); that is, the heirs of the slain have been given the right or authority or power to kill the murderer in retaliation, or to take blood-money (diyah) from him, or to pardon him. Retaliation has been declared a cause of life and of peace and tranquillity for human society. As Allah the Exalted says: “In retaliation there is life for you, so that thereby you may refrain (from unlawful killing).” (Al-Baqarah 2:179) When the murderer fears that he too will be killed in retaliation, then he will not have the courage to kill anyone, and in a society where this law is enforced, this fear protects the society from murder and bloodshed, through which the society enjoys great peace and tranquillity. In another narration it comes thus: “The believer remains at ease within the spaciousness and openness of his religion so long as he does not shed any forbidden blood.” (on the authority of Bukhari)
In general, every evil is a cause of decline for man’s religious and moral life and a cause of Allah’s wrath, but here, in particular, it has been made clear regarding the worst deed of unlawful bloodshed that so long as a person does not stain his hand with anyone’s unlawful blood, the hand of Allah’s mercy remains upon him; but when a person stains his hand with unlawful blood, hardship is imposed upon him and he becomes among those people who remain deprived of Allah’s mercy.
