وقف قائم کرنا
عَنِ ابْنِ عُمَرَ رَضِىَ اللهُ عَنْهُمَا قَالَ أَنَّ عُمَرَ بْنَ الْخَطَّابِ أَصَابَ أَرْضًا بِخَيْبَرَ فَأَتَى النَّبِىَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ يَسْتَأْمِرُهُ فِيهَا فَقَالَ يَا رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ إِنِّى أَصَبْتُ أَرْضًا بِخَيْبَرَ لَمْ أُصِبْ مَالًا قَطُّ أَنْفَسُ عِنْدِى مِنْهُ فَمَا تَأْمُرُ بِهِ؟ قَالَ إِنْ شِئْتَ حَبَسْتَ أَصْلَهَا وَ تَصَدَّقْتَ بِهَا. قَالَ فَتَصَدَّقَ بِهَا عُمَرُ أَنَّهُ لَا يُبَاعُ وَ لَا يُوهَبُ وَ لَا يُورَثُ. وَ تَصَدَّقَ بِهَا فِى الْفُقَرَاءِ وَ فِى الْقُرْبَى وَ فِى الرِّقَابِ وَ فِى سَبِيلِ اللهِ وَابْنِ السَّبِيلِ وَالضَّيْفِ وَلَا جُنَاحَ عَلَى مَنْ وَلِيَهَا أَنْ يَأْكُلَ بِالْمَعْرُوفِ وَ يُطْعِمَ غَيْرَ مُتَمَوِّلٍ.
حضرت عبداللہ بن عمر رضی اللہ عنہما سے روایت ہے کہ (میرے والد) عمر بن الخطاب کو خیبر میں کچھ زمین ملی تو آپ رسول اللہ صلی اللہ علیہ وسلم کی خدمت میں مشورے کے لیے حاضر ہوئے اور عرض کیا: ”یا رسول اللہ صلی اللہ علیہ وسلم! مجھے خیبر میں کچھ زمین ملی ہے، ایسا (نفیس اور قیمتی) مال مجھے اس سے پہلے کبھی نہیں ملا۔ آپ صلی اللہ علیہ وسلم اس کے بارے میں کیا حکم فرماتے ہیں؟“ رسول اللہ صلی اللہ علیہ وسلم نے فرمایا: ”اگر چاہو تو اصل زمین اپنی ملکیت میں رکھو اور اس کی پیداوار صدقہ کر دو۔“ ابن عمر فرماتے ہیں کہ حضرت عمر نے اس کو اس شرط کے ساتھ صدقہ کر دیا تھا کہ نہ اسے بیچا جائے گا اور نہ اس کو ہبہ کیا جائے گا اور نہ اس میں وراثت چلے گی۔ اسے آپ رضی اللہ عنہ نے محتاجوں، قرابت داروں، غلام آزاد کرنے کے لیے، مجاہدوں کے لیے، مسافروں کے لیے صدقہ (وقف) کر دیا۔ اور یہ کہ اس (وقف) کا نگراں اگر دستور کے مطابق اس میں سے اپنی ضروریات کے لیے یا کسی محتاج کو دے تو اس پر کچھ مضائقہ نہیں۔ (صحیح البخاری، کتاب الوصایا، باب: الشروط فی الوقف، رقم الحدیث ۲۷۳۷)
شرعی طور پر وقف کے معنی یہ ہیں کہ کسی چیز کو اللہ کی راہ میں دے دینا اس طور پر کہ اس چیز کی اصل محفوظ رہے اور اس سے حاصل ہونے والی آمدنی جائز جگہ پر خرچ کرنا جس سے اللہ کی مخلوق فائدہ اٹھائے لیکن اسے فروخت یا ہبہ وغیرہ نہ کرنا۔ ہمارا دین انسان کو خرچ کرنے کی دعوت دیتا ہے۔ اسلامی معاشرہ برخلاف دوسرے معاشروں کے انفاقی معاشرہ ہے۔ قرآن پاک میں اللہ تعالیٰ کا ارشاد ہے:
﴿کون ہے جو اللہ کو قرض حسنہ دے تا کہ اللہ کئی گنا کر دے۔﴾ (بقرہ۔۲۴۵)
جب یہ آیت شریفہ نازل ہوئی تو ایک صحابی نے اپنا ایک باغ جس میں سات سو کھجور کے درخت تھے اللہ کی راہ میں صدقہ کر دیا اور ان کی بیوی اور بچے جو اس باغ میں رہتے تھے ان کو لے کر وہاں سے چل پڑے اور اس وقت ان کی اہلیہ کہہ رہی تھیں کہ آپ نے بہت اچھا سودا کیا۔
اللہ کی راہ میں کسی چیز کو وقف کرنا ایک ایسا انفاق ہے کہ اس سے انسان کو اس کی زندگی کے بعد بھی اس کا اجر و ثواب ملتا رہتا ہے۔ مسلمانوں میں ابتدا ہی سے اس کا رواج رہا ہے یہاں تک کہ صحابہ کرام میں سے کوئی ایسا نہیں تھا جس نے اپنی جائداد میں سے کچھ نہ کچھ وقف نہ کیا ہو۔ اور اس سنت میں اہل خیر آگے بڑھاتے رہے ہیں۔ ماضی میں مسلمانوں نے ہر طرح کے وقف قائم کیے تھے، مثلاً: مساجد کی تعمیر کے لیے وقف، تعلیمی اداروں کے لیے وقف، ہسپتالوں کے لیے وقف، شاہراہوں پر مسافروں کی سہولتوں کے لیے وقف، ضرورت مندوں کے لیے مکانات تعمیر کرنے کے لیے وقف، بے روزگاروں کے لیے طعام گاہوں کے لیے وقف، کنویں کھدوانے کے لیے وقف، دودھ پیتے بچوں کے لیے دودھ کی فراہمی کے وقف، یتیموں کے لیے وقف، غریبوں لاوارثوں کے کفن دفن کے انتظام کے لیے وقف، اللہ کی راہ میں جہاد کرنے والوں کے لیے وقف، غریب لڑکے اور لڑکیوں کی شادیوں کے لیے وقف، حیوانات کی دیکھ بھال کے لیے وقف وغیرہ۔
یہ راہ آج بھی کھلی ہوئی ہے بلکہ اس کی اشد ضرورت ہے کہ ہم مختلف طرح کے اوقاف قائم کریں جن سے معاشرے کی مختلف ضروریات پوری ہوں۔
ہمارا دولت مند طبقہ جو ایک معمولی تقریب پر لاکھوں خرچ کر دیتا ہے جس کا حاصل چند لمحوں کی خوشی ہے لیکن جب اسے اللہ کی راہ میں خرچ کرنے کو کہا جاتا ہے تو اس پر لرزہ طاری ہو جاتا ہے۔ اس میں اس کو اپنا خسارہ نظر آتا ہے حالانکہ یہی اس کی کمائی ہے باقی سب کچھ یہیں رہ جانا ہے۔

English translation
Narrated ‘Abdullāh ibn ‘Umar (may Allah be pleased with them both): (My father) ‘Umar ibn al-Khaṭṭāb acquired some land at Khaybar, so he came to the Prophet ﷺ to seek his counsel about it and said: “O Messenger of Allah ﷺ, I have acquired some land at Khaybar. I have never obtained property (so fine and) more precious to me than this. What do you command me to do with it?” The Messenger of Allah ﷺ said: “If you wish, keep the land itself in your ownership and give its produce in charity.” Ibn ‘Umar says that ‘Umar gave it in charity on the condition that it would not be sold, nor given away as a gift, nor inherited. He (may Allah be pleased with him) devoted it as charity (waqf) for the needy, for relatives, for freeing slaves, for those who fight in the way of Allah, and for travellers. And there is no blame upon the one who administers it (the waqf) if he takes from it according to what is customary for his own needs or gives it to someone in need.
In the terminology of the Sharī‘ah, waqf means to give something in the way of Allah in such a manner that the asset itself is preserved and the income derived from it is spent in a lawful cause from which Allah’s creation benefits — but the asset itself is not sold or gifted away. Our religion invites man to spend. Unlike other societies, Islamic society is a society of giving. Allah says in the Holy Qur’an:
“Who is it that will lend to Allah a goodly loan, so that He may multiply it for him many times over?” (al-Baqarah, 245)
When this noble verse was revealed, one of the Companions gave in the way of Allah a garden of his containing seven hundred date palms, and taking his wife and children who lived in that garden he set out from there — and at that moment his wife was saying, “You have made a very fine bargain.”
Devoting something as waqf in the way of Allah is a form of spending whose reward continues to reach a person even after his life has ended. It has been the practice among Muslims from the very beginning, to the extent that there was not one of the noble Companions who did not devote some part of his property as waqf; and the people of goodness have carried this sunnah forward ever since. In the past Muslims established endowments of every kind — for example: waqf for building mosques, waqf for educational institutions, waqf for hospitals, waqf for the comfort of travellers on the highways, waqf for building houses for the needy, waqf for food kitchens for the unemployed, waqf for digging wells, waqf for providing milk for nursing infants, waqf for orphans, waqf for arranging the shrouding and burial of the poor and those with no family, waqf for those who fight in the way of Allah, waqf for the marriages of poor young men and women, waqf for the care of animals, and so on.
This path is still open today; indeed there is an urgent need for us to establish endowments of various kinds through which the different needs of society may be met.
Our wealthy class, which spends hundreds of thousands on an ordinary function whose entire yield is a few moments of pleasure — when it is asked to spend in the way of Allah, a shudder comes over it. In this it sees only its own loss, whereas this is in fact its true earning; everything else is to be left behind right here.
