اولاد میں انصاف

حضرت نعمان بن بشیر رضی اللہ تعالیٰ عنہما سے روایت ہے کہ میرے والد مجھے لے کر حضور صلی اللہ علیہ وسلم کی خدمت میں حاضر ہوئے اور کہا: ”اے اللہ کے رسول صلی اللہ علیہ وسلم میں نے اپنے اس لڑکے کو ایک غلام بخش دیا ہے، آپ صلی اللہ علیہ وسلم نے پوچھا، کیا تو نے اپنے سب لڑکوں کے ساتھ ایسا ہی معاملہ کیا ہے؟ انہوں نے، یعنی بشیر رضی اللہ تعالیٰ عنہ نے کہا نہیں، تو آپ صلی اللہ علیہ وسلم نے فرمایا، اللہ سے ڈرو اور اپنی اولاد میں برابری اور مساوات کا معاملہ کرو۔“ حضرت نعمان رضی اللہ تعالیٰ عنہ فرماتے ہیں کہ حضور صلی اللہ علیہ وسلم کے فرمانے پر میرے باپ نے اس غلام کو واپس لے لیا۔ (بخاری و مسلم)
اسلام ایک مکمل اور جامع دین ہے جو زندگی کے ہر پہلو پر رہنما اصول عطا کرتا ہے۔ تربیت اولاد انسانی معاشرے کا ایک انتہائی اہم مسئلہ ہی نہیں بلکہ یوں کہا جائے کہ غلط ہو تو غلط ہی ہوگا۔ اولاد کی تربیت ایک کل قومی ذمہ داری ہے۔ اس ضمن میں مذکورہ اس حدیث میں آپ صلی اللہ علیہ وسلم نے یہ ہدایت فرمائی ہے کہ عطاء و بخشش میں سب کے ساتھ انصاف کا برتاؤ کیا جائے، یہ نہ ہو کہ کسی کو زیادہ نوازا جائے اور کسی کو محروم رکھا جائے یا کم دیا جائے، یہ چیز بذات خود بھی مطلوب ہے اور اس میں عدل و انصاف کا بھی تقاضا ہے جو اللہ تعالیٰ کو محبوب ہے۔ اسلام تو وہ دین ہے جو مسلمانوں کو یہ تعلیم دیتا ہے کہ عدل و انصاف کی راہ کبھی نہیں چھوڑنی، چاہے معاملہ کافروں سے ہی پیش ہو۔

حدیث مبارکہ میں جو ہدایت کی گئی ہے اس میں یہ حکمت بھی ہے کہ اگر اولاد میں سے کسی کو زیادہ نوازا جائے اور کسی کو کم تو ان میں باہم بغض و حسد پیدا ہوگا جو دین اور تقویٰ کے لیے تباہ کن اور ہزار فتنوں کی جڑ ہے۔ ایک اور روایت میں ہے کہ آپ صلی اللہ علیہ وسلم نے فرمایا کیا تم چاہتے ہو کہ تمہاری سب اولاد یکساں طور پر تمہاری فرماں بردار اور خدمت گزار بنے؟ انہوں نے عرض کی ہاں! حضرت یہ ضرور چاہتا ہوں، تو آپ صلی اللہ علیہ وسلم نے فرمایا تو پھر ایسا نہ کرو (کہ ایک کو دو اور دوسرے کو محروم رکھو)۔

بعض دین سے ناواقف لوگ اس طرح کا فرق رکھ کر خصوصاً بیٹیوں کا حق مار کر اپنے اور معاشرے کے لیے خود اپنے ہاتھوں سے مشکلات و مصائب کو فروغ دیتے ہیں اور شریعت کے خلاف کرتے ہیں۔

واضح رہے کہ یہ حکم عام صورتحال کا ہے، خصوصی حالات میں خصوصی سلوک خلاف انصاف نہ ہوگا بلکہ ایک درجہ میں ضروری اور باعث ثواب ہوگا۔ مثلاً اگر کوئی بچہ ایسا ہو جو کسی مرض کا شکار ہے یا اگر کسی بچے کو دین و ملت کی خدمت میں لگا دیا ہے کہ معاشی جدوجہد کے لیے وقت نہیں نکال سکتا تو ایسی صورت میں اس کے ساتھ ترجیحی سلوک جائز بلکہ باعث اجر ہوگا۔
English translation
Nu'man ibn Bashir (may Allah be pleased with them both) reported: My father took me to the Messenger of Allah ﷺ and said, "O Messenger of Allah, I have given this son of mine a slave." The Messenger of Allah ﷺ asked, "Have you treated all your children the same way?" He — that is, Bashir (may Allah be pleased with him) — said, "No." So the Messenger of Allah ﷺ said, "Fear Allah, and treat your children with equality and fairness." Nu'man (may Allah be pleased with him) says: On the command of the Messenger of Allah ﷺ, my father took the slave back.

Islam is a complete and comprehensive religion that gives guiding principles for every aspect of life. The upbringing of children is not merely a most important matter of human society — indeed it may be said that if it goes wrong, wrong it will remain; rather it is an entirely collective responsibility. In this connection, in the hadith mentioned above, the Prophet ﷺ gave the guidance that in giving and granting, justice should be shown to all — it should not be that one is favoured more while another is deprived or given less. This is desirable in itself, and it also fulfils the demand of justice and fairness which is beloved to Allah. Islam is the religion that teaches Muslims never to abandon the path of justice and fairness, even when the dealing is with disbelievers.

Another wisdom in the guidance given in this blessed hadith is that if some of the children are favoured more and others less, mutual malice and envy will arise among them, which is ruinous for faith and piety and the root of a thousand troubles. In another narration the Prophet ﷺ said, "Do you not wish that all your children be equally obedient and dutiful to you?" He said, "Yes, sir, I certainly wish that." So the Prophet ﷺ said, "Then do not do this (giving to one and keeping the other deprived)."

Some people ignorant of religion, by making such a distinction — especially by denying daughters their rights — with their own hands promote hardships and troubles for themselves and for society, and act against the Sharia.

It should be clear that this ruling concerns the general situation; in special circumstances special treatment would not be against justice but may, to a degree, be necessary and a source of reward. For example, if a child is afflicted with some illness, or a child has been devoted to the service of religion and the community so that he cannot find time for earning a livelihood, then in such a case preferential treatment towards him is permissible and indeed a source of reward.
