بیویوں کے ساتھ برابری

حضرت ابو ہریرہ رضی اللہ تعالیٰ عنہ سے روایت ہے کہ رسول اللہ صلی اللہ علیہ وسلم نے ارشاد فرمایا: ”جب کسی آدمی کی دو (یا دو سے زیادہ) بیویاں ہوں اور وہ ان کے ساتھ عدل و مساوات کا برتاؤ نہ کرے تو قیامت کے دن اس حالت میں آئے گا کہ اس کا ایک دھڑ گرا ہوا ہوگا“۔ (ترمذی، ابو داؤد، نسائی و ابن ماجہ)
اسلامی شریعت میں انسانوں کی مختلف حالتوں کا لحاظ رکھتے ہوئے مناسب شرائط کے ساتھ چار بیویوں تک کی اجازت ہے، رسول اللہ صلی اللہ علیہ وسلم کی لائی ہوئی شریعت میں زنا خاص کر شادی شدہ آدمی کے لیے زنا اتنا شدید گناہ ہے کہ اس کی سزا سنگساری ہے، ایسی شریعت میں اگر کسی حال میں تعدد ازواج کی اجازت نہ دی جاتی تو انسان پر قانون کی یہ بہت بڑی زیادتی ہوتی، کیونکہ بہت سے لوگ اپنی طبیعت اور مزاج کے لحاظ سے اور بہت سے اپنی بیوی کے مخصوص حالات کی وجہ سے ایسے ہوتے ہیں کہ اگر ان کو ایک سے زیادہ بیوی کی اجازت نہ دی جاتی تو اس میں بڑا خطرہ تھا کہ وہ حرام کاری میں مبتلا ہوجاتے۔

اب اگر کوئی شخص ایک سے زیادہ بیویاں رکھتا ہے تو اس کے اوپر یہ فرض ہے کہ سب کے ساتھ یکساں برتاؤ کرے اور کسی کے ساتھ معمولی سی بھی ناانصافی نہ کرے۔

اللہ تعالیٰ قرآن پاک میں اس طرح حکم دیتے ہیں:

”اور عورتوں سے نکاح کیا کرو جو تمہارے لیے حلال ہیں، خواہ ایک سے خواہ دو سے خواہ تین سے چار سے، پھر اگر ڈرو کہ ان میں انصاف نہ کرسکو گے تو ایک ہی نکاح کرو“۔ (النساء ۔ ۳)

اس حدیث مبارکہ سے بھی ہمیں یہ بات معلوم ہوتی ہے کہ جو لوگ بیویوں کے ساتھ برتاؤ میں عدل اور برابری نہیں کرسکیں گے تو آخرت میں ان کے لیے انتہائی رسوا کن عذاب ہوگا، یعنی جو معاملہ اور برتاؤ میں ایک بیوی کی طرف جھکتا تھا، قیامت میں اس کا ایک دھڑ گرا ہوا ہوگا، اللہ کی پناہ کیسا دردناک منظر ہوگا اور کیسی رسوائی ہوگی۔
English translation
It is narrated from Abu Hurairah (may Allah be pleased with him) that the Messenger of Allah ﷺ said: "When a man has two (or more) wives and does not treat them with justice and equality, he will come on the Day of Resurrection in such a state that one side of his body will be hanging down (fallen)."

(Tirmidhi, Abu Dawud, Nasa'i and Ibn Majah)

Islamic law, taking into account the various circumstances of human beings, permits up to four wives under appropriate conditions. In the law brought by the Messenger of Allah ﷺ, adultery — especially for a married man — is such a grave sin that its punishment is stoning. Had such a law not granted permission for plural marriage in any circumstance, it would have been a great injustice upon man, because many people, by reason of their temperament and disposition, and many because of their wife's particular circumstances, are such that had they not been permitted more than one wife there would have been a great danger of their falling into unlawful (adulterous) conduct.

Now if a man keeps more than one wife, it is obligatory upon him to treat them all equally and not to do the slightest injustice to any of them.

Allah commands thus in the Holy Qur'an: "Marry such women as are lawful for you, two, three or four; but if you fear that you will not be able to do justice between them, then (marry) only one." (An-Nisa — 3)

From this blessed hadith we also learn that those who fail to act with justice and equality in their treatment of their wives will face an utterly humiliating punishment in the Hereafter — that is, whoever leaned in his dealings and conduct towards one wife, on the Day of Resurrection one side of his body will be hanging down. Allah's refuge is sought — what a dreadful sight it will be, and what a disgrace!
